These Terms of Use ("Terms") govern your access to and use of the website at https://costtoupgrade.com and the calculators, guides, and related services we provide (collectively, the "Site"), operated by CostToUpgrade ("CostToUpgrade", "we", "us", or "our"). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.

TO THE FULLEST EXTENT PERMITTED BY LAW, CostToUpgrade AND ITS OWNERS, OPERATORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE SITE OR ANY ESTIMATE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US$100). Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the United States and the State in which CostToUpgrade is established, without regard to its conflict-of-law principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to their personal jurisdiction, except where applicable law gives you the right to bring a claim in your local courts.

Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CostToUpgrade regarding the Site and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it.
